These Terms & Conditions (“Terms”) govern your access to and use of WhaleTrigger.com and any related services, applications, APIs, or communication channels (collectively, the “Services”).By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.If you do not agree with any part of the Terms, please discontinue use of the Services immediately.

1.Acceptance of Terms

WhaleTrigger (“Whale Trigger”, “we”, “our”, “us”) provides the Services subject to your compliance with these Terms.Additional terms may apply to specific features (e.g., API usage, paid subscriptions).Those additional terms become part of your agreement with us if you use those features.

2.Eligibility

You must be at least 18 years old and capable of forming a binding contract under applicable law to use the Services.By using the Services, you represent and warrant that you meet these requirements.

3.Account Registration

• You may create an account using an email/password, Web3 wallet signature, or third-party authentication (e.g., Telegram).
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You must immediately notify us of any unauthorised use of your account.

4.Subscriptions & Billing

• Certain features (e.g., Pro Alerts, premium API quotas) require a paid subscription.
• Prices, billing cycles, and plan limits are described on the pricing page and may change with at least 14 days’ notice.
• Payments are processed via third-party providers (Stripe for USD/crypto, Midtrans for IDR).We do not store full card details.
• Subscriptions renew automatically unless you cancel before the next billing date.
• Refunds: Monthly plans are non-refundable once a cycle begins.Annual plans may be refunded pro rata within 14 days of purchase.

5.Use of Services

• Whale Trigger provides data and alerts for informational purposes only. Nothing on the platform constitutes financial, investment, or trading advice.
• You are solely responsible for any trading or investment decisions you make based on the information provided.
• We may modify, suspend, or discontinue any part of the Services without liability.

6.Prohibited Activities

You agree not to:

1. Use the Services for any unlawful purpose or in violation of any applicable laws or regulations (including US, Indonesian, and local jurisdiction laws).
2. Attempt to reverse-engineer, decompile, or gain unauthorised access to our systems or data.
3. Resell, redistribute, or publicly display data obtained from the Services without a commercial licence.
4. Use automated scripts (bots, scrapers) outside our official API rate limits.
5. Engage in activity that could disable, overburden, or impair the Services.

7.API Terms

• Each API key is tied to a single account and must be kept confidential.
• Rate limits are enforced; exceeding limits may result in throttling or suspension.
• We reserve the right to audit your usage to ensure compliance with these Terms.

8.Intellectual Property

All content, software, and data on WhaleTrigger.com—including logos, graphics, and aggregated metrics—are the property of Whale Trigger or its licensors and are protected by copyright, trademark, and other laws.You receive no licence or ownership rights except as expressly set out in these Terms.

9.Disclaimer of Warranties

The Services are provided on an “as-is” and “as-available” basis.To the fullest extent permitted by law, Whale Trigger disclaims all warranties, express or implied, including any warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement.

10.Limitation of Liability

To the maximum extent permitted by law, Whale Trigger, its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.Our total liability to you for any claim arising from the Services will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD 100.

11.Indemnification

You agree to indemnify, defend, and hold harmless Whale Trigger and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

12.Termination

• You may cancel your account at any time from your dashboard or by emailing [email protected].
• We may suspend or terminate your access immediately for breach of these Terms, court order, or unlawful behavior.
• Sections 8–12 survive termination.

13.Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict-of-law provisions.Any dispute arising under these Terms will be resolved through good-faith negotiations; if unresolved, the dispute shall be submitted to the exclusive jurisdiction of the courts of Jakarta, Indonesia.

14.Changes to Terms

We may revise these Terms from time to time.We will post the updated Terms with a new “Last updated” date.Material changes will be communicated via email or an in-app notice at least 14 days before they take effect.Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
